New York Airbnb Law Explained: NYC's Rules and the 2025 State Law

Is Airbnb banned in New York? Inside New York City, nearly. Everywhere else, no. What NYC's Local Law 18 requires and what the 2025 state law changed for hosts upstate.

By Marisa @ RevWhisperLast updated

Airbnb isn't banned in New York State, but New York City's Local Law 18 makes most short-term rentals there illegal: stays under 30 days require city registration, the host living in the unit during the stay, and no more than two guests. Outside the city, the main change is a state law that took effect in 2025: booking platforms now collect New York's 4% state sales tax and local sales tax, and counties can create their own registries and occupancy taxes. Towns still set their own zoning and permit rules.

Is Airbnb banned in New York?

Not statewide. New York City's rules amount to a near-ban on whole-home short-term rentals, which is where the "ban" headlines come from. Upstate and on Long Island, short-term rentals are legal subject to town zoning, county registries and taxes.

What is NYC's Local Law 18?

Local Law 18 created a registration system for short-term rentals in New York City, enforced from September 2023 by the Mayor's Office of Special Enforcement. According to the city, short-term rentals are only legal if the host lives in the same unit as the guests, guests have access to the whole unit, and there are no more than two guests, not counting children under 4. Hosts must register and show the registration number on listings, and platforms can't process bookings for unregistered units. Over 3,500 hosts had registered by 2026, against tens of thousands of listings before the law.

Do NYC's rules apply to one- and two-family homes?

Yes. The same host-present and two-guest rules apply to houses, and one- and two-family homes make up about two-thirds of registered units. A City Council bill to let owners of those homes rent without being present failed. A newer bill, Intro 1107, introduced in December 2025, would drop the host-present rule and raise the guest limit; it was still before the Council as of October 2026. Stays of 30 nights or more fall outside Local Law 18.

What are the penalties for illegal Airbnbs in NYC?

Hosts can be fined up to $5,000, with the amount depending on how many violations they have, and booking platforms face penalties of up to $1,500 for each illegal booking they process, according to news coverage of the law. Advertising an illegal rental carries separate civil penalties.

What changed for New York Airbnb hosts outside NYC in 2025?

A state law signed in December 2024, finalized by a February 2025 amendment, treats short-term rentals like hotels for sales tax. From March 1, 2025, booking platforms collect the state's 4% sales tax and local sales tax on stays under 30 days they handle. Counties can also create a short-term rental registry and add their hotel and motel occupancy tax. Counties that wanted to opt out of the registry had until December 31, 2025.

Do upstate New York towns have their own Airbnb rules?

Many do. Towns and villages set zoning, permits, occupancy limits and caps, and resort areas in the Catskills, Hudson Valley and Adirondacks have tightened rules in recent years. Check your town clerk or code office and your county's registry status before you list.

Pro tip: Search your town's name plus "short-term rental law" and read the town's own code, not a summary.
